Terms of Service

Welcome to TikAgent. These Terms of Service ("Terms") govern your access to and use of the TikAgent platform, website, and services (collectively, the "Service") operated by TikAgent ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

TikAgent is a content management and automation platform designed for independent music creators. The Service enables users to:

• Import and manage original music tracks
• Analyze audio properties including BPM, mood, key, and energy levels
• Generate AI-powered video content synced to music
• Optimize content with AI-generated titles, hashtags, and descriptions
• Publish video content to TikTok via the official TikTok Content Posting API
• Track content performance through analytics

TikAgent acts as an intermediary tool that facilitates content creation and publishing. All content is published through official TikTok APIs in compliance with TikTok's developer terms.

2. Account Registration and TikTok Authorization

To use certain features of the Service, you must connect your TikTok account through TikTok's official OAuth 2.0 authorization flow. By connecting your account, you authorize TikAgent to access the following on your behalf:

• user.info.basic: Your TikTok username, display name, and avatar for display within the TikAgent dashboard
• video.publish: The ability to publish video content to your TikTok account on your behalf
• video.upload: The ability to upload video files to TikTok's servers for publishing

You may revoke TikAgent's access to your TikTok account at any time by disconnecting your account within TikAgent's settings or revoking access through TikTok's app authorization settings at Settings > Security > Manage app permissions.

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

3. User Content

You retain all rights, title, and interest in and to any content you upload, create, or publish through the Service, including but not limited to music files, video content, text, titles, hashtags, and descriptions ("User Content").

By using the Service, you grant TikAgent a limited, non-exclusive, non-transferable license to process, analyze, and transmit your User Content solely for the purpose of providing the Service to you. This license terminates when you delete your content or close your account.

You represent and warrant that you own or have the necessary rights and licenses to all User Content, that your User Content does not infringe upon the intellectual property rights of any third party, and that you have the right to grant the licenses described in these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Upload, publish, or distribute content that you do not own or have the rights to use
• Violate TikTok's Terms of Service, Community Guidelines, or Music Usage Policy
• Engage in spam, including mass-posting repetitive or low-quality content
• Upload content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity
• Attempt to circumvent any rate limits, security measures, or access controls
• Use the Service for any illegal purpose

5. TikTok Integration

The Service integrates with TikTok through official TikTok APIs. Your use of TikTok through our Service is also subject to TikTok's own Terms of Service and Privacy Policy. TikAgent is an independent platform and is not affiliated with, endorsed by, or sponsored by TikTok or ByteDance.

6. Content Publishing

Content is published to TikTok only after your explicit confirmation. Before any content is posted, you will be presented with a preview of the video content, the title, description, hashtags, privacy level settings, interaction settings, and content disclosure options. You are solely responsible for reviewing and approving all content before publishing.

7. Music Usage Confirmation

By publishing content through TikAgent, you acknowledge and agree to TikTok's Music Usage Confirmation. You represent that you have the right to use any music included in your published content.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

The TikAgent name, logo, website design, software, and all related intellectual property are owned by TikAgent and are protected by applicable intellectual property laws.

10. Third-Party Services

TikAgent integrates with third-party services: TikTok API (authentication and publishing), Anthropic Claude AI (content analysis and optimization), and Runway ML (AI video generation). Your use of these services through TikAgent is subject to their respective terms.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TikAgent shall not be liable for any indirect, incidental, special, consequential, or punitive damages. The Service is provided "as is" and "as available" without warranties of any kind.

12. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your access at any time, with or without cause. Upon termination, your TikTok authorization will be revoked.

13. Changes to Terms

We may update these Terms from time to time. We will revise the "Last updated" date at the top of this page. Continued use constitutes acceptance of changes.

14. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany.
